Circulator.co.uk Anti-Spam Policy

Circulator.co.uk provides a permission-based Email Creation and Multiple Delivery Service ("ECMDS") for clients ("the clients") that own their own lists of customers, members, employees or other people who have given permission to send email communications to them, thus enabling the clients with the ability to make use of the ECMDS platform for their own personal or corporate use. The clients understand and abide to the principals of email protocol and of all EU and UK relevant legislation and codes. The clients are aware of the Circulator.co.uk Privacy Policy and Anti-Spam policy, and have accepted both in full, effective as of the commencement of their registration process. The clients have agreed to follow a strict "opt-in" policy and all further legal actions that insure fulfillment of the relevant laws.
Circulator.co.uk strictly adheres to industry and corporation privacy standards and to this end has established this zero-tolerance Anti-Spam Policy.
Indemnity As a condition of use of Circulator.co.uk ECMDS platform or any other of its chattels, the clients have agreed to indemnify Circulator.co.uk and its suppliers from and against any and all liabilities, expenses (including attorney's fees) and damages arising out of claims resulting from the clients use of the ECMDS platform, including without limitation any claims alleging facts that if true would constitute a breach by the clients of these terms and conditions.
Preventing SPAM All emails sent through Circulator.co.uk ECMDS platform are sent on behalf of the clients and consist of permission-based "opt-in" communications. "Opt-In" means that all recipients must have supplied at one time their email address to receive email communications and/or have a pre-existing relationship with the clients.
Circulator.co.uk will not, under any circumstances, tolerate the use of its ECMDS platform to send unsolicited commercial email ("SPAM") whether or not for commercial purposes. All Circulator.co.uk clients are aware of and follow the US Federal CAN SPAM Act and take full responsibility for all liability if any spam damage occurs. Circulator.co.uk has a zero-tolerance policy and will immediately terminate the account of any of the clients using its ECMDS platform to send spam or to engage in any illegal action of such nature and sort. Circulator.co.uk reserves the right to determine in its sole discretion what measures are further necessary in response to such spam activities caused by the clients, apart from immediate notice to the client and various other actions, some of which are technical in nature. This policy is designed to protect the integrity of the Circulator.co.uk ECMDS platform for all of its clients with legitimate permission-based lists and to insure the fulfillment and implementation of the law.
Circulator.co.uk ensures that all contact lists, email content and reports remain private and confidential. Circulator.co.uk may scan the content of the clients email communications taking effect on the ECMDS platform or involve usage of any other chattel owned by Circulator.co.uk. These actions are intended to ensure the clients actions comply and protect against defamatory, abusive, obscene, profane, or threatening material that is racially or ethnically offensive.
Precautions
- Circulator.co.uk will make all technical means to insure that each and every email communication of the clients, which had been created using Circulator.co.uk ECMDS platform, will contain a clearly visible "unsubscribe" hyperlink, thus providing the recipient the ability to Opt-Out successfully. Once a recipient has unsubscribed, the Circulator.co.uk ECMDS platform is technically designed to never allow the client who makes use of it to send future email communications to that specific recipient's email address. Additionally, each possible recipient on a client operated subscriber list, will be enabled with the option of unsubscribing through a web-based method provided on Circulator.co.uk website.
- All Circulator.co.uk clients have agreed to make use and publish a valid return email address of which they own and are related to, that would appear in the "from" field.
- All Circulator.co.uk clients have agreed to state their actual business license's physical postal address in the body of all email communications which take into effect using the ECMDS platform.
- Circulator.co.uk clients have been instructed and have accepted not to make use of any false headers or other misleading information, to hide the point of origin or the transmission path of the email, or to disclose the true origin of the email sender.
Report SPAM Circulator.co.uk calls upon any private person or corporate organization which suspect that Circulator.co.uk ECMDS platform or any other of its chattels has been used to send spam, to kindly contact Circulator.co.uk representatives immediately at abuse@circulator.co.uk. Circulator.co.uk will investigate accordingly.
Dispute account termination If any of Circulator.co.uk recipients or clients have reason to believe that Circulator.co.uk had terminated their customer account in error, kindly send an email to suspend@circulator.co.uk. Circulator.co.uk shall review the matter and make all possible means to solve it as soon as possible.
